Hi,

Ordered a SPV500 as an upgrade, got it delivered on the 14th June, activated
it etc same day. The thing sporadically dies on me (crashes, won't allow
calls to be picked up etc.). I phoned Orange and said that i'm fed up with
it and that I would like a different model phone. They have declined my
request and say that I can only have a replacement of the same model as it
is after 7 days of the activation...... I'm not really too happy about this
as I have now heard that they are very hit and miss as to quality and can't
spend my life hanging around waiting for couriers.

I believe you have 14 days minimum to send something back, under the
"Distance selling Rules".

Furthermore, try the approach that you "Reject the goods as not being fit
for the purpose intended".

Once you have rejected the goods, and they have collected/received back from
you, start over again = new contract.

You believe wrong.

The DSR exists to allow people the chance to inspect the goods as they
would have the opportunity to do in a shop. Having taken the phone out
of the box and used it is going beyond "examining the goods" and the DSR
don't apply.

Orange will allow the cancellation of an upgrade within 7 days, for any
reason, however this user is beyond 7 days.

I thought it was 14 days as well actually, but i've just had a look at the
Business Link website ( http://www.businesslink.gov.uk ) and it says that
it's 7 days.

It does look like they've got me nailed down pretty well but it's hardly
good customer relations, I was 4 days outside that when I first phoned them
& I do want an upgrade and to stay with them for another year, just not that
damn phone.

I think i'll get a replacement and ebay it .............

The C500 is a top phone. Do a software update on it to make sure but
mine has never crashed don me.

You won't get a different model out of Orange so don't waste your time
trying.

Whoever told you they were "hit and miss" probably only had their one
single experience to draw upon.

I've personally sold around 200 of hthese thing, including 41 to a
single customer and I've had one or two back in for repair but that's no
different to any other handset,

Hmm, just phoned them and talked to someone else. Return bag's in the post &
upgrade cancelled. I guess it just depends who you talk to and what mood
they're in which seems a little bit silly. All sorted in the end though.

the inconsistency and dog headedness + declining service levels, lack of
decent bundles. and the WORST GPRS in the western hemisphere.

i might have to pay a left nut for vodamoan gprs payg but at least it
works when i need it to. unlike orange when it would feel like it.
